1. Definitions

• Acceptance / Accepted – Agreement by the Hirer to hire Equipment as per the Offer.

• Additional Equipment – Any extra items requested by the Hirer.

• Cancellation – Termination of a booking sent via email

to quotes@coolcatremovals.com.au.

• Cancellation Fee – 20% of the Hire Fee if cancelled within 3 working days of delivery.

• COD – Cash on Delivery.

• Contract – This agreement between Cool Cat Removals (the Owner) and the Hirer.

• Day – A calendar day.

• Delivery Address – The address where Equipment is delivered, unless otherwise

agreed.

• Deposit – Upfront payment required to confirm the hire.

• Dry Hire – Equipment hire without any additional labour.

• Duty – Any government-imposed levy or fee.

• Equipment – All Eco Tubs and other items listed in the Offer, including any additions.

• Essential Term – A non-negotiable condition of this Contract.

• GST – Goods and Services Tax as per A New Tax System (GST) Act 1999.

• Effective Control – The party responsible for the Equipment during the hire period.

• Hire Fee – The total cost (including GST) for the hire period.

• Hirer – The individual or company hiring the Equipment.

• Offer – The Hirer’s accepted booking or order.

• Owner – Cool Cat Removals.

• Period of Hire – From delivery to the agreed return or collection date.

• Service Area – Within 25km of Clayton South, Melbourne. Services outside this area

require prior written agreement.

• Services – Any additional labour (e.g. delivery, pickup, relocation) provided by Cool Cat

Removals.

• Site – The location where Equipment is used or delivered.

• Special Conditions – Any custom terms in the Offer to Hire.

• Venue – The place where Equipment is being used.

• Wet Hire – Hire including Cool Cat Removals team for assistance (e.g. setup or

moving).

2. Acceptance

2.1. This agreement becomes binding when you accept the Offer or accept delivery of

Equipment.

2.2. Cool Cat Removals may withdraw an Offer before Equipment is delivered.

2.3. Once accepted (in writing, verbally, or by conduct), the Contract becomes active.

2.4. Acceptance by a third party is treated as acceptance by the Hirer.

3. Payment Terms

3.1. Payment must be made by the date specified in your quote. COD or prepayment

may apply.

3.2. If payment is required upfront and not received, we may delay or cancel delivery.

3.3. Early payment discounts may be offered at Cool Cat Removals’ discretion.

3.4. We may request valid photo ID (e.g. driver’s license) upon delivery for verification.

4. The Equipment

4.1. Equipment always remains the property of Cool Cat Removals.

4.2. Suitability for your purpose is not guaranteed unless agreed to in writing.

4.3. Report any shortages or faults within 24 hours of delivery.

4.4. When Equipment is under your control, you must:

• Use it carefully and return it in good condition

• Not attempt repairs or tamper with it

• Be liable for any loss or damage not caused by Cool Cat Removals

• Keep Equipment secure at all times

• Not transfer it to others or remove ID labels

4.5. You are responsible for replacing or covering the repair of lost or damaged

Equipment.

4.6. If Equipment is not returned as agreed, we reserve the right to enter the Site and

retrieve it. You indemnify us for any costs or legal consequences.

4.7. Daily hire charges will continue until Equipment is returned or fully compensated

for. We may also charge for lost opportunities or replacements due to unavailability.

5. Services

5.1. If Cool Cat Removals is providing delivery, collection or other services, the Hirer

must:

• Ensure access to the Site

• Provide a safe environment for our team

• Allow adequate time for collection

5.2. Responsibility for the Equipment passes to you upon delivery.

5.3. You are also responsible for:

• Providing a safe and suitable area for setup or use

• Ensuring any facilities (e.g. elevators or ramps) are functional

5.4. Free delivery and collection is available within 25km of Clayton South. Additional

travel charges apply beyond this radius. If unsure, contact us

at quotes@coolcatremovals.com.au.

5.5. Hire extensions must be approved by Cool Cat Removals before the scheduled

collection.

6. Default Events

6.1. The Hirer is in default if:

• Any Contract terms are breached and not fixed within 7 days

• An Essential Term is breached

• The Hirer becomes insolvent, bankrupt, or subject to legal administration

6.2. In the event of default, Cool Cat Removals may recover the Equipment without

notice.

6.3. You indemnify us against any legal claims, damages, or costs related to

repossession.

7. Warranties

7.1. Unless clearly stated, no warranties apply to the Equipment.

7.2. All warranties legally excludable are excluded.

7.3. Where the law requires it, Cool Cat Removals’ liability is limited to:

• Supplying equivalent Equipment

• Reimbursing the cost of replacement

• Refunding the Hire Fee

8. Limitation of Liability

8.1. Cool Cat Removals is not liable for:

• Incorrect or insufficient Equipment ordered

• Delays in delivery or pickup

• Losses resulting from your misuse or negligence

8.2. You indemnify Cool Cat Removals against any claims from third parties due to

unsafe Site conditions.

8.3. If you fail to notify us of damaged or missing items within 1 business day, you

accept the Equipment in the condition it was delivered.

9. Cancellation

9.1. Cancellations must be made in writing via email

to quotes@coolcatremovals.com.au.

9.2. Your cancellation must clearly identify which items are being cancelled.

9.3. A 20% Cancellation Fee applies if cancelled with fewer than 3 business days’ notice

before the scheduled delivery date.

10. Deposit

10.1. A Deposit may be required to secure your booking. The Contract is not valid until

the Deposit is received.

10.2. The Deposit will be applied toward the Hire Fee, or may be withheld if the booking

is cancelled under Clause 9.

11. Ownership

11.1. This is a hire-only agreement. No Equipment is sold or transferred as part of this

Contract.

11.2. You acknowledge that all Equipment, including Eco Tubs and accessories,

remains the exclusive property of Cool Cat Removals.

12. Governing Law

12.1. This agreement is governed by the laws of Victoria, Australia.
